"Petition" to Overturn Sheriff's Runoff Election

My letter of request will be first, with Lorie Moose's letter next, followed by the       documentation requested.   The computer generated printouts are not available on the website due to size.  My notes are listed in red after the date of the open rec. req. to bring your attention to certain matters of documentation.  Click on the Blue link to view the documentation.

1. 4/21/2006 Open Records Request for:  (Notice that the RoB for Precinct 19; see the handwritten number in the bottom right hand corner of the rob, is blank yet all of a sudden later on in the process, on number 4 below that the RoB for Precinct 19 turns up, and is filled in.  It is not right though.  Makes you wonder just what is going on!!!!!

4/25/2006 Lorie Moose’s Response Letter To 4/21/2006
            (1) List of Provisional Voters
                (a) No Provisional Voters

          RoB’s (b) Stated was able to locate for Precincts
                    4,7,9,10,11,14,17,19,24,27,28,29,30,31,32
            (3) Ballot and Seal Certificates
 Tracking Logs (c) She stated that she had all requested 23,
                   but she did not provide the requested
                   documents, she provided the JBC
                   / MBB/ eSlate Serial Numbers and Tracking Log)  Moose tried to pass off the Electronic Voting machine seals as the ballot and seals certificates for the paper ballot boxes.  We know that she later called Hart Printing and asked them to fax a copy of the Ballot and Seal Certificate to her because as she told them, she had never seen one before.  (Oh yes, we did talk to Hart Printing, the company that prints the ballots)

2. 5/16/2006 Open Records Request for: 
               (1) Copies of the Precinct Returns for each of the 23
                   Precincts Including the Original and the 3 copies.
               (2) The list of the Election Judges for Each of the 23
                   precincts, listing name addresses and phone no.

3. 5/17/2006 Open Records Request for:  (Notice the response in (e) below, how the early voting box was sealed and where it was stored)
               (1) Copies of all of the Application for Ballot by Mail
               (2) The total number of Mail ballots that were
                   received back in the mail.
               (3) Copies of records from Early Voting
                   Machine on Any Cancelled Ballots
               (4) Copies of the Documentation on the Seal
                   and Serial Numbers for the Early Voting
                   Polling Box at the end of each day.

    5/22/2006 Lorie Moose’s Response Letter to 5/17/2006
                (1) Copies of all applications for ballots by mail
       Applications (a) 27 pages supplied at first then
                       (aa) 1 page showed up later that she said was
                            misplaced (the 28th. and last page)
                (2) The total number of mail ballots that were
                    received back in the mail
                    (b) 56 ballots were returned by deadline
                        she only gave us 55 envelopes (front & back)
                (3) Copy of Record from Early voting machine

                     (e) A paper seal was not used daily for the
                         small flap end of the ballot box. A lock
                         was placed on it daily and kept in the
                         County Clerk’s office.

5. 5/19/2006 Open Records Request for: (These tapes are just like the RoB's for the paper ballots.  Notice by looking on the spread sheet Page 64 of the PDF which tapes are missing from each precinct.  These tapes are just as important as the RoB's when it comes to the electronic machines, but a lot of them are missing also!!!  See page 64 for the spreadsheet of missing tapes.  It shows just how sloppy the documentation for elections is in this county.

6. 5/24/2006 Open Records Request for:
               (1) The computer generated list of persons who voted in
                   the runoff race for sheriff.
               (2) Copies of the back and front of the envelopes of mail
                   in ballots received after the cutoff date, and if they
                   were counted or not.

                       By law, Donnie Gentry, and Laquita Brown should have been    counted because they are in a combat zone overseas.
7. 5/24/2006 Open Records Request for:
               (1) Copies of the front and back of Envelopes signed
                   by the Voter for the return of Early Voting Ballots.
               (2) Requests for cancellations of Mailed out ballots.

                (1) Copies of the front and back of Envelopes signed by
                    the voter for the return of early voting ballots.
          Envelopes (a) 55 envelopes copied. 56 carried to early voting
                        ballot board and one rejected because
                        signatures did not match
                (2) Requests for cancellations where persons who
                    were mailed early ballots, either cancelled or
                    returned their ballot.

8. 5/26/2006 Open Records Request for:  (This is the second request for the Ballot Box Seals and documentation)  She gave us copies of some seals, but no documentation other than a number written on the page with the seal, because as you will see in a later request there was no documentation made or any other seals used in this election as per the Texas Election Code.  Notice that the hatch end of the boxes were not sealed, and that there were no seals used to seal the deposit slot end after voting.    Also notice in 1 (b) below that Moose states that there were no ballot and seal certificates sent in the kits by Hart Printing who is the Company certified by the Secretary of State.  We contacted Hart and talked with one of the Executive Managers there.  He stated that the kits are made up and stored in inventory between elections.  All kits are pulled from inventory when ordered by various locations.  They had no complaints from any other locations that the Ballot and Seal Certificates were missing from their kits, and thinks it unlikely that Red River County just happened to receive 23 kits pulled from inventory that just happened to be missing the ballot and seal certificates!!!

                   documentation of receipt of the sealed boxes at the

               (3) Copy of the Invoice from Hart Print Company Listing
                   the total number of ballots Printed and received for
                   the sheriff’s runoff election including starting and
                   ending serial numbers.

6/1/2006 Lorie Moose’s response letter to 5/26/2006
           (1) Copies of the ballot box seals and documentation
               for all ballot boxes delivered to and used by the precincts.
         Seals (a) Copies of the seals that could be located are
                   are attached. These red wire hasp seals were
                   placed on the slot of the box for depositing
                   ballots along with a regular lock.
               (b) A ballot and seal certificate was not provided
                   in the kits that were ordered from Hart
                   Intercivic, therefore none exists.  (This was used as an excuse for not filling out the required documentation required by the Texas Election Code!)

           (2) Copies of any mail ballots returned undeliverable
               by the US Postal Service.
               (c) There were no ballots returned to this office
                   undeliverable.

9. 5/26/2006 Open Records Request for:  (If you will notice that she states that she has no documentation to try and show that the runoff is by code!  But, after we filed the petition to overturn the election, and during the time before the hearing, the county clerk must have burned the midnight oil to come up with enough documentation and the ballots.

10. 5/26/2006 Open Records Request for:  (Notice that these RoB's from the Primary Election are in the same shape as the ones from the Runoff.  That tells you that they are not doing their jobs according to the Texas Election Code in any of the previous elections. All documentation is supposed to be stored in box 4 for easy access for 22 months after the election.  They do not even bother to try and store the documentation properly much less fill it out!)

11. 6/2/2006 Open Records Request for: (These are truncated) (Notice number (2) in this one.  Also note number 6,7, and 8 plus the response in the letter from Moose for these 3.  Numbers 6,7,and 8 are the 3rd request for ballot and seals documentation as required by law.
               (1) Copies of any open records requests filed by Terry
                   Reed or his lawyers including Judy Hodgkiss of the
                   Moore Law Firm L.L.P., and copies of the documents
                   provided to them on those requests.
               (2) Copies of any documentation on changes that have
                   been crafted from information learned in the process
                   of this legal action that has caused you or your
                   employees to make changes to the way in which
                   your office will hold future elections.

               (3) Starting and ending Serial numbers for the unused
                   ballots for each of the precincts in the Precinct 32
                   early voting Box.
               (4) Per Texas Election Code §127.002 thru §127.006
                   (Attached), I hereby request the neams of the
                   following individuals who served in the positions of:
                   Counting Station Manager
                   Tabulation Supervisor
                   Assistants to Tabulation supervisor (if any)
                   Presiding Judge of the Counting Station
                   Counting station Clerks (if any)

                (5) Per Texas election Code § 127.002 I hereby
                    request a copy of your Plan for Counting station
                    operation.

                (6) Copies of any records prepared for preserving the
                    serial numbers of the seals on ballot boxes sent
                    to the polling stations. If no documentation is
                    available please state none available.

                (7) Copies of any records prepared for preserving the
                    serial numbers of the seals on ballot boxes sent
                    to the counting station sealing the deposit slot or
                    any paper seals themselves with signatures on
                    them. If no documentation available please state
                    none available.


                (8) Copies of any records used at the counting
                    station by the presiding judge or the judges
                    designee used to inspect the seals on
                    the incoming ballot boxes to the counting
                    station to insure the seal on box is intact
                    or the seal on the deposit slot corresponded
                    with the record at the counting station to show
                    there were no irregularities in the manner
                    in which the returning ballot boxes were
                    handled. If no documentation available please
                    state none available.

               (a) I have received no open records requests from Terry
                   Reed or his lawyers including Judy Hodgkiss or

               (a) I drafted new procedure for ballot boxes used for
                   paper ballots. This procedure may or may not
                   complete at this point.

               ballots for each of the precincts in the Precinct 32
               early voting Box.
               (a) These ballots were selected at random and are
                   not necessarily in numerical order. You, however
                   are welcome to come and view them for yourself
                   and write down the remaining serial numbers or
                   copy them.

               & Plan positions of Counting Station Manager, Tabulation
               Supervisor, and Assistants to Tabulation Supervisor
               Presiding Judge of Counting Station and Counting
               Station Clerks.

            (5) Copy of plan for counting station operation

            (6) Copies of any records prepared for preserving the serial

                numbers of the seals on ballot boxes sent to the polling stations.

                (a) No documentation available

            (7) Copies of any records prepared for preserving the

                to the counting station sealing the deposit slot,
                or any paper seals.
                (a) I have already supplied you with the ballot
                   and seal certificate for the electronic
                   equipment. No documentation exists for
                   ballot boxes containing paper ballots.

I do not understand.  If we as taxpayers have paid for all the expenses of sending Moose for training, and I am sure that after all of these times, it was not cheap on us, then why in HELL did she not run the elections by law.  Whose influence is causing her not to run the elections properly in this County??  Maybe we paid, and she had a good time!!!!

                   of paper ballots scanned by precinct. Please
                   generate a copy of that lists for all 23 precincts.
