  The letter on the left dated March 29, 2006 is from the City of Garland, Assistant City Attorney Mark G. Mann.  In it he states that he has received the "open records request" requesting the copy of the "public information request" of the "Arresting Officers Report"  on Royce Daniel Abbott.

The "open records request" is the present request.  The "public information request" is the supposed request Mark Perkins listed on his e-mail.

  In the letter Mr. Mann  states that "extensive searches have been conducted at both the Garland Police Records Department and the City Attorney's office in an attempt to locate any responsive request which may have been received."  Their search "has been primarily limited to requests received by the City since December 2005, although computerized searches have been conducted for a much larger period of time.  Despite these extensive efforts, the City has been unable to locate any record of a request for this information having ever been received."

  If you check the E-Mail Header on the right from County Attorney Val Varley's Investigator Mark Perkins e-mail, and note the date and time he sent it out to all the people he sent it to, you will notice that it was sent Thursday March 16, 2006 at 13:35:17.  For those of you that do not know military time that is 1:35:57p.m. in the afternoon.  This definitely puts Val Varley's Investigator Perkins "at work and on a County Computer."  Val Varley's Investigator Mark Perkins lists the subject as "Sheriff Candidate", and then makes the statement below it that  "This was obtained through Open Records Act from Garland PD."  Appointed Acting Sheriff Reed definitely knew about this incident because Val Varley's Investigator Perkins E-mailed him the "Arresting Officers Report".  He is listed in the group that received the E-mail first.  Whom did he forward it to after he received it. 

  I know for a fact that the City of Garland is definitely doing everything possible to find the person or persons responsible for releasing this record and the "public information request" that caused it's release.  The City Attorney may seem cool when he states that "If you have any questions, please feel free to contact me at the number listed above.", but he is most definitely concerned and active in investigating this situation.  All Government entities (including Red River County) are required by law to keep records on everything, including all e-mails sent and received on their computers. ( All E-Mails sent from government entities are considered "Official Public Documents" and are subject to all open records request.  Destruction of these e-mails is considered a violation of law, because it is destruction of an "official public record." )  This incident of no "public information request" record of the release of the "Arresting Officers Report"  puts the City of Garland into the position of possible lawsuit.  I can tell you from living in the City of Garland most of my life, that they are very definitely not corrupt, and have a legal department that is above reproach.  If the City of Garland cannot produce the record showing who requested the "Arresting Officers Report", it is viewed as an "illegal act".  When this happens, The City of Garland and the Garland Police Department will most likely launch an internal affairs investigation to find "the person or persons" responsible for this "illegal act", and unlike the Red River County Sheriff's department will uncover the "person or persons" involved and most likely prosecute them. 

  If the City of Garland finds it to be an "illegal act", then Red River County will quite possibly find itself under investigation by outside agencies for a possible conspiracy to affect the outcome of an election.  If conspiracy is found it will end in prosecution of the parties involved.  The punishments and laws are listed in my Response Letter to Abbott Arrest Report Posted 3/23/2006. Punishments can range up to and include a 3rd. Degree State Jail Felony.  This is a very serious situation. with very serious consequences.
