Dear Citizens,

  Is it true what I was told about Mark Perkins, Investigator for the County Attorney’s office making the statement that, “We are going to do anything and everything we can to keep Royce Abbott from being elected sheriff?” 

  It seems Perkins has given us a sample of the “anything and everything”. It shows how far our county officials and sworn peace officers will go to attempt an influence on the outcome of the runoff election for sheriff.   This proves that they will do “anything and everything” to keep an honest man like Royce Abbott from being elected Sheriff.

  I received a copy of an arrest record number 22628, See Arrest Record dated 3-14-70, from the Garland Police Department the City of Garland on Royce Daniel Abbott for the offense of “assault with the intent to commit murder”.  The e-mail originated from Mark Perkins. E-Mail Header Page  You can tell from the time it was sent, and the originator always moves to the bottom as the e-mail is forwarded.

  Yes there was an arrest report on Mr. Abbott.  Sgt. Charles Moore of the Texas Rangers, and the Garland Police department, stated that Mr. Abbott was cleared of all charges, and that the arrest should have never been made.  The District Attorney listed on the arrest record knew at the time that the listed complainant had given a sworn statement to the police that Royce Abbott was not involved, and not at fault, but the DA  insisted on the arrest anyway.  RRC citizens understand what a District Attorney will do when he has a personal agenda, rather than impartially protecting the citizens.

  1. A criminal background check using our tax dollars, had to be run because there is no other way to find this record exists.  It is illegal for anyone, peace officer or otherwise to use the system without a just cause.  A just cause would be an ongoing investigation.   Running for Sheriff does not require and ongoing investigation.  The Texas Govt. Code Sec. 411.083 thru 411.085 covers the use of the criminal background check, and this check was illegally run.  The penalty covered by 411-089 states that it is a 3rd degree felony punishable by state jail time.  If the background check was run on the national system, the FBI will become involved, and this will be a federal crime. 
  2. The Secretary of State’s attorney in the elections division, Joe Kulhavy jd. whom I spoke with, said this incident possibly violates Section 62 of the Texas Civil code, and Section 2.054 of the Texas Election Code which if it is determined was violated, is a Class A misdemeanor punishable by up to one year of incarceration in the County Jail.  There are also possible violations of Chapter 36 and Chapter 39 of the Texas Penal code dealing with voter coercion by a public servant or voter.  The nature of the underlying coercion determines the punishment ranging from a Class B offense to a 3rd. degree State Jail Felony.  He also stated there may be other specific crimes committed by the person or persons involved, and charges could be filed on those once the complaint is filed with the Texas Attorney’s General office.
  3. This information obtained illegally with your tax dollars, was faxed and e-mailed all over the county using county computers and county e-mail access. We have the address where this originated, and most everywhere it was sent to, and each individual occurrence could result as a separate crime. The Texas Attorney’s General office views election violations or tampering, and releasing illegally obtained criminal histories to the general public as criminal offenses.  

  Now after we have chewed the fat, just who has committed the illegal act here, Royce Abbott who was arrested 36 yrs. ago and found totally free of guilt, or the person or persons who have committed possible criminal violations, by  using a record obtained by an illegal criminal background check using your tax dollars, and county computer equipment?

  A formal complaint will be filed with the Texas Attorney’s General office.  The person who ran the check used a Login to the system which leaves a record.  The name of the person who requested the record from the Garland Police Department is on a signed request.  We know who sent these e-mails and they could possibly be criminally prosecuted for their part of a possible election tampering conspiracy.

  Now good citizens and voters, I hope that all of you see this for what it is. It is a false attempt at influencing the outcome of this election.  This is an attempt by a licensed peace officer of this county to victimize another innocent person they definitely do not want looking into their past actions.  What is it our “appointed Sheriff” and elected officials are so desperate to keep hidden?  It must be something BIG for them to attack a good man that has said absolutely nothing bad about any of them, especially risking possible criminal charges and prosecution for doing it.

  By Law, Royce Abbott could not have remained licensed as a peace officer for 25 more years after the occurrence, and still remain a licensed peace officer today if this arrest was good. Royce could not have received a carry permit, which he has.  Mr. Abbott followed the Rules and Regulations of the Police Department to the letter during this occurrence, and was totally and completely cleared of any wrong doing.  This was an arrest not a conviction.  You can bet if there was a conviction against Abbott, Perkins would have included that in the e-mail also.  Innocent people in this county have been arrested, and some convicted because they are helpless against the system.  Hell, one of our better Commissioners is still being victimized by the system.  RRC Citizens are afraid to speak out because the system is used to victimize the innocent rather than punish the criminals. 

  Peace officers have been used as part of the political antics of elected officials (as this 36 year old arrest is being used now) to attempt to bring about desired political gains. This is a just a taste of what some of our sworn peace officers and elected officials are capable of in an attempt to keep the “booger in the courthouse” hidden.

 Being reasoning, thinking, informed voters you know this as an attempt to fix the outcome of this election.  Do you really want to elect their “appointed one” who allows “anything and everything” to keep Royce Abbot from being elected sheriff.  Is their “appointed one” the type of person you want to hold the highest law enforcement office in this county with his responsibility being the safety of your children and your family? 

  I know Royce Abbott is an honest and truthful man.  He has not stooped to their level of politics. I am proud to support Royce Abbott in this sheriff’s race no matter what the personal costs.  I hope that every registered voter will get out and vote for a change in the way our Sheriff’s Department and elected officials are doing business. Send a clear message to them and our elected officials allowing the illegal use of your tax dollars, and computer equipment to do “anything and everything” to any citizen for official gain.  A copy of this letter, and supporting documents was forwarded by e-mail to the FBI.
