"Royce Abbott Speaks Up"

 

Ladies and Gentlemen, Tax Payers, Voters, Citizens Of Red River County:

 

     I was born here in Red River County seventy years ago.

     Many of you can relate to that period of time.  Back then very little attention was given to local politics.  In those days everyone was to busy trying to make a living to be concerned with what was going on within the local government.  For that very reason a small group of people gained power within our county government and since that time they have dictated to the rest of us what we can and what we cannot do.

     My name is Royce Abbott and I have an opinion about the future of Red River County.

     It is my opinion that Red River County is a cesspool of corruption in a downward spiral.  The farther we go the deeper and dirtier it gets.  Check the records!  It is seldom if ever that a county office is filled by election in Red River County. They are filled first by appointment giving that person the advantage, then by election which is controlled at the voting booths by this same group of people mentioned earlier.

      I was present at a commissioners court meeting several months past when an issue came before the court.  I do not recall the specifics, but Judge Peek made the statement, "I know this is not right, but this is the way we have always done it".  The proposition was put before the court and passed.

      Ladies and Gentlemen, Judge Peek works for you and I.   If something comes before the court that is not right he should not put that item up for a vote just because they have "always done it that way".  He should explain what is right if he knows, and then ask the court for a decision.

      Yes, Judge Peek was first appointed to the position that he now holds, and yes he will resign before his term is up and a predecessor will be appointed just as it has been in the past unless you and I say that we have had "Enough." We can put the people's majority back in control of our county government instead of the choice few that has always run the county government, if we organize and work together.

      We must demand that when a county office is vacated that the runner-up in that election, if contested, has first choice. If that person declines, then the people should have the right to decide who fills that office not two or three members of the commissioners court.

       People,  you must take control.  You must go to the polls and demand that your voice be heard or this county is dead.  Some of you have lived here all your lives. Have you seen prosperity? Have you seen industry and jobs come here? Have you seen business and opportunity come here? Or have you seen a small group of people fight anything that might give the working class of people the opportunity to survive in Red River County?  You are the majority.  You can control your government.  If these elected officials do not enforce your will, the will of the people, go to the polls on election day and vote them out of office.

       It's up to you.  You must demand that your voice be heard. You must demand that these elected officials who work for you, who's salaries you pay, enforce your wishes or you will let this small group of criminals who dictates the county's every move force you into exile as they have always intended to do.

  It is time that we all stood up for our rights as Citizens.  Citizens of the United States are guaranteed rights under our Constitution, and no one is going to give you those rights unless they understand that you are willing to stand up for them.

 

  We have the right to life, liberty, and the pursuit of happiness, and our elected officials do not have the right to take any of those rights away from us for any reason. 

 

  Red River County is known throughout the State of Texas by citizens and elected officials as the most Corrupt county in the State of Texas.  I am always hearing "Why doesn't someone come in and clean up this County?"  I am going to tell you why not.  It is because you as citizens do not exercise your rights. 

 

 To have good health you must exercise....  no, you do not necessarily have to go to the gym to lift weights, but every little bit of exercise you do helps you to be healthier.  The same is true with your rights as a citizen of the United States.  You must exercise your rights to make them strong, and even if you don't go to the extreme to exercise them everything, including the little things, helps your rights to grow stronger.

 

  To clean up this county so that we all have more prosperity you must report injustices, corruption, and stand up against illegal acts committed by our elected officials and law enforcement.  There is always someone who you can send your complaints to. 

 

  There are State Representatives, State Senators, the Governor, the Attorney's General of the State of Texas.  If the person is a State Employee, they have a superior, and their superior's have superiors. There are "Checks" and "Balances".

 

  This website is here to be a light in the darkness to educate you about your rights and give examples to those of you who have been "illegally wronged" by the justice system in Red River County.  It is also here to show you that elected officials are our "Public Servants", no matter what their title, all the way from District Judges, District Clerks, County Attorneys, County Clerks, Sheriffs, County Commissioners, District Appraisal Offices, County Judges, Justices of the Peace, County Constables, Police Officers, Mayors, City Councilman, School Boards, City Secretaries, Dog Catchers, City Judges, Chief's of Police, Patrolman, Sheriff's Deputies, Texas Rangers, DPS Officers and any other official who acts on behalf of the People, in an official capacity, must follow the law just like the rest of us.  These officials take an oath to be in office, and that oath binds them to obey and uphold the law.  They can also be removed from office by any citizen if they break the law.  See: Removal of Officials from Office

 

  All of these officials must follow the laws of the State of Texas, and if they don't you have the legal right to file complaints, or petition the court to remove them from office.  Sometimes those complaints must be filed with their immediate Superior's, but never the less, the complaint must be filed to protect and exercise your rights as a Citizen of the United States.  If you file your complaint, make sure that you also CC, or Carbon Copy that complaint to those up the line in the chain who have a legal responsibility to protect your rights.  It will also come in handy if you decide to hire an attorney to have someone removed from office because they have committed a violation of their "Oath of Office", and done nothing with your complaint.

 

  Let's say that I have a complaint against a Sheriff's Deputy, or even the Sheriff.  First I would write the letter of complaint and address it to the Sheriff, and request an investigation.  I would CC on the complaint showing everyone that had copies of the complaint in it's entirety, and in this case the County Attorney, the District Judge, The Attorney General, My State Senators, My State Representatives, and the Governor.  I would state the complaint, and if necessary go to a notary public and swear a statement.  I would demand an investigation, and a remedy for my complaint according to the law, and if I was able to locate the law stating the infraction I would include a copy of it with my complaint.  You can go to an attorney, and ask for assistance by having him or her discuss your complaint with you, and read the copy of your complaint, and make necessary corrections to your complaint.  An attorney can also recommend the people you CC your complaint too.  It will probably cost a small amount of money to do this, but it is all part of exercising your rights as a citizen.

 

  There are always superiors in government, including state laws to bind them to hear your complaint and respond.  There is the State Board of Judicial Review for Judges.  There is the State Bar of Texas for Attorneys.  There are your "Elected Officials" in state government, and making your complaint known to your elected officials lets them know that you are willing and able to stand up for your "Rights as a Citizen of the United States". 

 

  The Laws of our Great Nation, and the laws of The Great State of Texas are written by your "Elected Representatives", and they wrote them to protect all the Citizens, not just the elected officials,. even thought sometimes they are written in such a way as to give the "Elected Official" the loophole. 

 

  If an official knows for a fact that you are "Ready and Willing" to exercise your rights, they will be very careful not to step on them, and they will "Follow the Law", as all of us should. 

 

  So, the next time you wonder "Why doesn't someone come in and Clean Up the Corruption in Red River County?", take a good long look in the mirror at yourself, and see if you are willing to "Exercise your Rights" as a Citizen!!!! 

 

Landfill Case Decided

                                                                                                    December 22, 2006

 The court has decided.  The 200th District Court in Travis County has decided in favor of the Plaintiff Edwin Kelso. 

The meaning of this as I understand it from M. Mark Lesher attorney of record is that this ruling opens the path for the landfill completely.  This ruling is a win because now the application is back in to the TCEQ's hands, and causes them to have to consider the application, and give it the same consideration as every other application that comes in for a permit.  The TCEQ must allow the application to follow the process and any problems with it to be worked out.  The application was not found to be "administratively incomplete" as the regulatory provisions cited by the Defendants all expressly limit their application to claims that were denied for that condition.  In simple terms, the applications  cited to the court were not complete when they were denied, and that is not the case with this application.  The court also found that the Plaintiff did met the time frame to file for judicial ruling because the time frame started on February 2, 2006.

The second part of the decision cited by the Defendants all expressly limited their application to claims that had already found to be "administratively complete."   The court stated that the application was in this part of the action never found to be administratively complete, so the regulatory provisions cited by the Defendants were not sound argument.  At the present time there are no restrictions on an appeal that the court can find, and the parties have cited to no such rules.

 

If the court had ruled in favor of the Defendants, the application process would have had to start from the beginning, which would have put it squarely at odds with the ordinance passed by the commissioners court after this application was already in the system for approval.  This would have caused the Plaintiff to fight an uphill battle against the ordinance.  This ruling puts the application and the approval process ahead of the County ordinance, which means that it will be nearly impossible to stop the permit from being issued.

Well here it is almost Christmas, and I haven't written anything since October, and was told that I wasn't doing my job.  There is not much coming out of the County Government except unsubstantiated rumors but I will tell you what I am hearing, and you can go from there. 

First off, the Cattle case about the gentleman from Oklahoma is going to Federal Court.  The sale of the cattle had an offer of settlement, but did not settle, and the County Government is going to court.  They really ought to just settle, because I know that they were wrong in getting involved in a civil matter,  by trying to arrest and prosecute someone they shouldn't even have had on their radar screens in the first place.  They are going to lose big time, but they don't care because it is our tax dollars that is going to pay for the higher insurance premiums.  Sooner or later maybe the taxpayers will wake up and quit electing idiots to do the job of someone who should have the common sense not to do what our so-called elected officials do.  The laws should be changed to prosecute any official that violates a person's civil  or constitutional rights and the elected officials should have to spend a lengthy jail term and pay the person whose rights they violated large sums of money out of their own personal pockets.  That would definitely cease the bullshit in this county if that law were on the books, although you would have to have a Real Red River County Prosecutor instead of the "VV Express" to enforce the law, which we surely don't have.  These fools would rather sit on their backsides and draw a paycheck from the taxpayers and screw us, the innocent citizens rather than to do their jobs.  But, on the other hand you have to know your job to do it, and all we have here in this county is a bunch of want-a-bee's who think that they know the law.  I hate to tell all of you, but going to school will just not get it done, cause you have to have the common sense and the brains along with the schooling or you will never amount to more than you already are.

Red River County Sheriff's Department acting on a warrant from the "VV Express" arrested Gary Mackey owner of the 4-way Stop and Go out of Bogata on another civil matter of owing someone money. "BUT WAIT".... Gary did not owe anyone money. This debt was another person's debt altogether.  This makes his arrest even worse, and shows what our county legal system really is.  They are not interested in the law, or justice.   There is no debtor's prison in the United States.  When the "VV Express" and the county government sets their sights on someone, they will do anything to give them a ride on RR County even if it means that they have to trump up something.  They are only interested in screwing the person, and they could care less whether they are involved with what they are charging them with or not!   This possibly will sooner or later be another big time lawsuit.  If I were the Gary,  I would sue the idiots so hard their grandchildren would still have the taste in their mouth's 20 years from now. 

I have a audio tape of Texas Ranger Roger Lough telling Gary Mackey that he does not have a right to an attorney.  I also have a witness. :) I hate to tell you fools in law-enforcement in this county that If you have the money and want to hire an attorney to follow you around everywhere you go you have the right to do it, and no, the legal system does not have the right to tell you that you don't have the right to have one present anytime RR so-called law enforcement is going to ask you questions.    Idiots/ fools is all I can call them, and anyone who sides with them is an idiot/fool also.  Check Miranda....  You have a right to an attorney.  Think about it idiots/fools.... (and by idiots/fools I am not referring to anyone outside of the local government who is reading this)  If a criminal has a right to an attorney, someone who is not even under arrest damn sure has the right to one being present!!!!  This tape and the transcript of it has already fallen into the hands of someone who has some authority over idiots/fools, and there will be some consequences.

After talking with a witness to the harassment who gave their statement :), and in my opinion from that witness statement :) , it appears, that for a while the City of Bogata law enforcement, the Red River County Sheriff's Department,  Texas Ranger Roger Lough and  the "VV Express" might possibly have been involved in trying to run this businessman and his business out of business.  The witness :) also states that the harassment is ongoing by law enforcement, but that it has lessened considerably, since the involvement of an attorney. This is another idiot/fool stunt, and another possible lawsuit.  When are they going to learn.......  like I said you have to have some common sense and some brains to learn,  and from what I can see they just don't get it, nor do they have it, and they don't have the capacity to grasp it.

I heard from an e-mail that there is some land being sold for taxes, and was told that it wasn't much use to bid on it, because the good ole boy system was going to see that it went to someone whom they saw fit to have it rather than a legitimate bidder.  I want to tell the person that if they had someone else they wanted to have it, that you would have never heard about it being sold for taxes, because it never would have made it this far.  It would have been sold before anyone even knew there were back taxes, in an under the table deal.  Don't you realize that criminal is all these officials understand?  If they had to do something the right way, it would break their sweetheart deals, and they damn sure couldn't have that happen.I also hear that Judge Peek is going to resign after the first of the year, and that Joseph Hausler is going to be appointed as judge.  I had someone tell me that at least with him in the position the criminal activity will slow up for a while, because he is not near as smart a Judge Peek!!!  God Help us All.

I also hear that Tim Shimpock is going to run for sheriff next time around.  I hear that he is going to church and everything to improve his image.  I hate to tell you that when you threaten and intimidate innocent citizens that going to church is not going to change your heart, and if the people are smart it won't change your image either.  Black is Black and White is White, nothing can change that, and a wolf in sheep's clothing is still a wolf even if he is grazing among the sheep.

I hear that the sheriff's department is doing nothing as usual.  I am sure that they will try to say differently, but from what I hear they are still arresting the victims and letting the criminals go free.  Oh, I forgot this is supposedly a county of outlaws, or at least that is what was said by someone who is closely related to the existing sheriff.

I talked to a close personal friend of mine who is an Assistant U.S. Attorney in the northern part of Texas.  This friend says that the corruption in East Texas is known, and that sooner or later something will be done about it.  My question is "When?"

Another 2 month's and more of the same (nothing changes) in RR County!!

 

County Probation Department

                                 October 10, 2006

I have talked with two different young women who have said that they have been victimized by the county justice system and the county probation department.  Both of these young women have stated to me that they were not "from Red River County", and that they have never been in trouble before in their lives.  Both of the young women have told me that due to family violence perpetrated on them by husbands who were "from Red River County"  that they were put into the system, and convicted of drug use or family violence when it was the husband's who were using the drugs and doing the violence, and they are still free, and still using drugs.  They have also told me that they seem to "always fail the urinalysis" when tested by the probation department even though they know that they are clean.  I have heard this from others out there who are male, but never believed it before.  These two young women do not have the look of a drug user, so I tend to believe them.  Their eyes are bright, and they are attractive to look at.  I haven't seen too many "drug users" who fall into this category, and drug users are not usually outgoing and friendly. 

I have also been told many times that once you are "in the system" here, and are nearing the end of your probation that the justice system finds a way to violate your probation to keep you in the system and paying the money.  Probation is a big business in this county, and the fees add up into very very large sums of money, so it would benefit this RR government to do something like this.  I would like to know just how many of the people who start on probation here actually get off.

Probation is set up to help people who have made mistakes to get back on their feet without having to serve all of their time locked away from society, not make money for the RR County system.  I abhor any system that uses the citizens to make money, even if some of them are "criminals".  If we don't treat the "criminals" like humans, then what do we treat our law abiding citizens like?  The system of probation here needs a change.  They need to stop operating it like a money making business and operate it like the system it was intended to operate like.  The system was intended to monitor, and help, not abuse the people in it.  Where is all of this money being used?  It seems that an awful lot of money is going into the governmental system here, but very little is coming back out......... I wonder where it is going.  Also where is the urine of the people who are clean going too?  Could it be used in place of the ones whom the system knows are dirty, because we all know that that tampering is possibly happening!!!!!!

Just a little something to think about.

This is a little more to think about.  There are people here who are in the probation system who have said that they don't trust the probation department because they always fail the urinalysis.  These people have come up with their own way to prove the system "crooked", and have gone to their physician's and had the urinalysis test run before going to the probation department.  Its funny that they pass the test with no drugs in their systems from a licensed M.D., but the test at the probation department comes back dirty.  What is going on?  It's the old matter of keeping the money coming in, and never letting the probationer finish the time.  It is a matter of where is their clean urine going too.  It is the matter of just what kind of officials do we have running this county.  It is the matter of the State of Texas evidently not giving a damn or doing anything when these people are being abused by the system that was set up to monitor and get them back into society.  It is the matter of "sordid affairs" in RR County according to what the 6th Judicial Court of Appeals in Texarkana thinks of the happenings here. 

How can our officials walk around town with their heads held up knowing what is happening. These officials like DA/CA Val Varley, Constable Tim Shimpock, Honorable Justice of the Peace J.R. Lewis, Sheriff Terry Reed, Honorable County Judge Powell Peek, and any of the others who walk around like nothing is happening, all the while knowing the truth, which can never pass their lips.  

Our fine officials are sworn to protect us (the citizens). Some go so far as to threaten us.  Others abuse us, while others pervert the law to suit their own needs.  If I knew what they did about this county I would be ashamed to look anyone in the eyes, and a few of them can't!!
